29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) On or about 5/23/2012, on the roof of the residence, employees who were installing new roofing shingles were not using any type of fall protection. The employees were exposed to falls of approximately 8 feet to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed. (a) On or about May 23, 2012, on the front near the left corner of the residence, employees were using a 14-foot aluminum extension ladder with side rails that did not extend at least 3 feet above the edge of the roof to access the roof. The employees were exposed to fall hazards of approximately 8 feet to the ground below. (b) On or about May 23, 2012, on the front near the front door of the residence, employees were using a 16-foot Werner aluminum extension ladder with side rails that did not extend at least 3 feet above the edge of the roof to access the roof. The employees were exposed to fall hazards of approximately 8 feet to the ground below.
