29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b): a) Landmark Home Improvement Company, LLC, Norwalk, Ohio: On or about May 23, 2012, at address 7 Gerard Drive, Norwalk, Ohio, the employer did not ensure that employees were protected from falls while engaging in roofing activities, such as, but not limited to installing new vents on a residential type structure. Employees were exposed to a potential 9 foot, 7 inch fall to the ground below.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards: a) Landmark Home Improvement Company, LLC, Norwalk, Ohio: On or about May 23, 2012, at address 7 Gerard Drive, Norwalk, Ohio, the employer did not ensure that employees had been trained in the appropriate use of fall protection, such as but not limited to the use of personal fall arrest systems. Employees were exposed to falls of approximately 9 feet 7 inches to the ground below, which could result in permanent disability or death.
