29 CFR 1926.651(i)(1):   Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing or underpinning was not provided to ensure the stability of such structures for the protection of employees:    Worksite, North side of Clinton Ave and West side of South 20th St., Newark, NJ    Excavation operations that were part of an underground petroleum tank removal and soil remediation project produced an excavation approximately 16 feet deep.  A portion of the right of way sidewalk and street on the South 20th Street side extended beyond and over the vertical excavation wall.  An employee operating a vacuum truck walked and worked near this sidewalk edge overhanging the excavation.  The employer did not shore or brace this excavation wall and right of way sidewalk and street to protect employees working near it.        Violation observed 5-23-12

29 CFR 1926.651(k)(2):  Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    Worksite, North side of Clinton Ave and West side of South 20th St., Newark, NJ    Excavation operations that were part of an underground petroleum tank removal and soil remediation project produced an excavation approximately 16 feet deep.  A portion of the right of way sidewalk and street on the South 20th Street side extended beyond and over the vertical excavation wall.   An employee operating a vacuum truck walked and worked near this sidewalk edge overhanging the excavation.  The employer's competent person did not ensure exposed employees were removed from the hazardous area until the cave-in or collapse condition was corrected.    Violation observed 5-23-12
