29 CFR 1926.651(g)(1)(i):     Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably have been expected to exist, the employer did not ensure that atmospheres in excavations were tested before employees entered excavations greater than 4 feet (1.22 m) in depth.    a)  1901 Birchwood Park Dr., Cherry Hill, NJ:  An employee was exposed to potential health hazards while working in a 7 foot deep trench with very nearly vertical walls.  The atmosphere of the trench could reasonably be expected to be hazardous due CO contamination due to the excavator running while digging the trench and also due the trenchs close proximity to motor vehicle traffic on Springdale Rd., a busy main thoroughfare.  The atmosphere in the trench had not been tested prior to the employees entry.  Observed on or about 05/31/12.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
