29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a) Jobsite: 325 Durham Street, Trench - On or about 6/7/12, employees in a ten foot deep trench were exposed to the falling hazard of excavated soil that had been placed above the employees and less than two feet from the excavation edge.       Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c).       (a) 325 East Dunham Street, Trench South End - On or about 6/7/12, employees working in a trench ten feet deep, four feet wide and eighteen feet long were exposed to cave in hazards at the south end of the trench with inadequate cave in protective systems not designed in accordance with @( CFR 1926.652(b) or (c).    (b) 325 East Dunham Street Trench North End - On or about 6/7/12, employees working in a trench ten feet deep, four feet wide and eighteen feet long were exposed to cave in hazards at the north end of the trench with no cave in protective systems.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
