OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to traumatic injuries when being liftedby standing on the forks of the forklift without the use of an approved personnel lifting device:     a) Warehouse -- On or about August 8, 2006, employees are being lifted over 14 feet while standing on the forks of the forklift to access the top level of the racking system and to reach/retrieve merchandise.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Warehouse Area - On or about May 31, 2012, employees handled beer line cleaner and acid line cleaner corrosives but the employer had not developed, implemented and or maintained a written Hazard Communication Program, exposing employees to potential safety and health hazards associated with the misuse or over-exposure to corrosive chemical compounds during handling.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) Entire Workshop Area  On or about May 31, 2012, employees handled beer line cleaner and acid line cleaner corrosives but the employer had not developed, implemented and or maintained a written Hazard Communication Program that included providing employees with effective information and training on hazardous chemicals, exposing employees to potential safety and health hazards associated with the misuse or over-exposure to corrosive chemical compounds.
