29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.        On or about June 13, 2012, an employee installing shingles was exposed to a fall of approximately 9 feet to the ground below.  The employee was not protected by a guardrail system, safety net system or personal fall arrest system.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:        On or about June 13, 2012, employees used a portable ladder to access the roof.  The side rails of the ladder did not extend 3 feet above the landing exposing employees to a fall when ascending and descending the ladder.
