29 CFR 1910.1200(e)(1): The employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training was not met, and which also includes the following: The employer is failing to ensure that the company has a written hazard communications (HAZCOM) program which contains all of the elements required by this subpart. The company has the required Material Safety Data Sheets (MSDS) for the materials and chemicals used in the facility but do not have the required written program to accompany all that they have done with regards to the health hazards in the facility.

29 CFR 1910.1200(h)(1): Employers had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. Throughout the facility - The employer is failing to provide Hazard Communication training to employees either during their initial assignment or whenever a new physical or health hazard that the employee has not previously been trained for has been introduced into their work area. Some of the employees in the facility had not received training on the hazards of the chemicals/materials in the facility in which they could be potentially exposed.
