29 CFR 1910.94(c)(4)(i): Spray rooms, including floors, were not constructed of masonry, concrete, or other noncombustible material. On or about June 28, 2012, and times prior there to, at this location, employees were exposed to fire when painting furniture inside of a spray room with chemicals such as, but not limited to, M102-0423 Tone Finish Clear Lacquer Sanding Sealer by RPM Wood Finishes Group. The doors to the room were made of wood.

29 CFR 1910.107(c)(2): There was an open flame or spark producing equipment in the spraying area or within 20 feet thereof, which was not separated by a partition. On or about June 28, 2012, at this location, employees were exposed to fire when applying flammable chemicals such as, but not limited to, M102-0423 Tone Finish Clear Lacquer Sanding Sealer by RPM Wood Finishes Group. Inside of the spray room there was located two energized electrical switches not enclosed in an explosion proof box.

29 CFR 1910.134(e)(6)(i): The employer did not obtain from the physician or other licensed health care professional (PLHCP) a written recommendation regarding the employee's ability to use the respirator: On or about June 27, 2012, and times prior there to, Furniture Technicians were required to wear a 1/2 face, negative pressure respirator when performing furniture painting and repairing. The employer did not obtain a written recommendation from the PLHCP.
