29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.        (a) Jobsite, Loot 7, Clifton Vista Estates, Murrysville, PA:  On or about 06/25/12, employees engaged in residential construction activities were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Employees were completing a roof on a newly constructed home approximately 20 feet above the ground and no fall protection systems were in place to prevent the employees from falling.  In addition, no fall protection plan was in place in that it was not infeasible to use conventional fall protection systems.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:        (a) Jobsite, Lot 7, Clifton Vista Estates, Murrysville, PA:  On or about 06/25/12, the employer did not retrain employees when inadequacies in the employee's knowledge or use of fall protection equipment indicated that they did not retain the requisite understanding or skill.  Employees were engaged in residential construction activities approximately 20 feet above the ground and no fall protection systems were in place to prevent falls indicating the employees did not retain the requisite understanding of the need to use this type of equipment for protection from falls.
