29 CFR 1910.119(h)(2)(iv): The employer did not develop and implement safe work practices consistent with paragraph (f)(4) of this section, to control the entrance, presence and exit of contract employers and contract employees in covered process areas.                                                                                      -In the Alternative-    29 CFR 1910.147(d)(5)(ii): When there was a possibility of reaccumulation of stored energy to a hazardous level, verification of isolation was not continued until the servicing or maintenance was completed, or until the possibility of such accumulation no longer exists.     This violation was most recently observed at KMTEX in Port Arthur, TX, in the ISOM Unit, when the employer did not ensure that the procedures to isolate and deinventory (lockout/tagout procedures) were effective in the continuation in the verification of isolation, when employees introduced plant nitrogen into the plumber's plug, while DME employees were performing maintenance on the Hot Oil line during the Biodiesel expansion project.

29 CFR 1910.147(c)(4)(ii): The procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance.    This condition was most recently observed at KMTEX in Port Arthur, TX, in the ISOM Unit, when the employer did not ensure that the energy control procedures clearly and specifically outline the techniques to be utilized for the control of nitrogen pressure when the employees introduced the nitrogen into the test plug/plumbers plug, when performing maintenance on the 10 inch pipe on the hot oil line for the Biodiesel Project.

29 CFR 1910.147(f)(3)(i): When servicing and/or maintenance was performed by a crew, craft, department or other group, they did not utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device.     This condition was most recently observed at KMTEX in Port Arthur, TX, when the employer, did not ensure that all employees in the ISOM Unit utilized a Lockout/Tagout procedure that afforded the employees a level of protection equivalent to protection provided by the implementation of a personal lockout or tagout device, when performing maintenance on the 10 inch pipe of the hot oil line for the Biodiesel Project.

29 CFR 1910.119(j)(6)(ii): Appropriate checks and inspections were not performed to assure that equipment was installed properly and consistent with design specifications and the manufacturer's instructions.     This condition was most recently observed at KMTEX in Port Arthur, TX, in the ISOM Unit, when the employer exceeded the maximum allowable backpressure to be applied to the test plugs/plumbers plugs, with plant nitrogen, during the maintenance tie in of the Biodiesel Project which was not consistent with design specifications and manufacturers instructions.
