29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section:    a) 1890 US Hwy 43, Mount Vernon AL; On or about July 11, 2012 the employer exposed employees to excavation cave-in hazards in that employees were allowed to work inside an excavation measuring five and half to six feet deep, 11 and half feet in width, and nineteen feet in length that was dug in wet class "c" previously disturbed soil with near ninety degree vertical walls.  The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
