Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to the hazard of falling from an exterior steel stairway: (a) Location Third Floor: On or about 7/12/2012, employees were exposed to falling from an exterior steel stairway ( fire escape) that was rusted, had broken stair treads and clearly visible cracks around the support brackets. Among other means, feasible means of abatement would be to instruct the employees to use the interior stairway from the third floor.
