29 CFR 1910.132(d)(1):     The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    a.  At the work site, employees were required to clean four employee and two public restrooms every two hours during the shift.  The employer did not have a written job hazard assessment that listed the exposure hazards for employees and the need for personal protective equipment (PPE).

29 CFR 1910.132(f)(1):     The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following:    a.  At the work site, employees who worked as baggers were required to check and clean four employee and two public restrooms every two hours during their shift.  The employer had not adequately trained the baggers on the use of personal protective equipment (PPE).

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    a.  At the work site, employees who worked as baggers used chemicals to clean and disinfect restrooms during each shift.  The employer had not provided the employees with adequate training on the types and hazards of the chemicals being used by employees.

29 CFR 1910.1200(g)(1):     Chemical manufacturers and importers shall obtain or develop a material safety data sheet for each hazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use.    a.  At the work site, employees used chemicals to clean the restrooms and other areas of the work site.  The employer did not have a material safety data sheet (MSDS) for all of the chemicals being used at the work site.
