29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems: a) Exposed steel beam structure of the canopy: On or about July 11, 2012, the employer did not ensure a fall protection method was implemented and/or used by employee(s) required to walk/work from on top of the exposed steel frame members of the canopy which exposed an employee to falls up to 17-feet to the paved ground below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Gas Station building roof top (parapet wall) located at 2020 Gulf Shores Pkwy, Gulf Shores, AL: On or about July 11, 2012, the employer did not ensure a fall protection method was implemented and/or used by employee(s) required to walk/work from the roof top of the building adjacent to the canopy which exposed employees to falls of approximately 15-feet over the parapet wall to the paved ground below.
