29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Shingle Rite Installers, Findlay, Ohio:  On or about July 25, 2012, at address 721 Colt Road, Findlay, Ohio, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Shingle Rite Installers, Findlay, Ohio:  On or about July 25, 2012, at address 721 Colt Road, Findlay, Ohio, the employer did not ensure that employees were protected from falls while applying new roofing to a steep sloped roof on a residential type structure.  Employees were exposed to a potential fall of approximately 9.3 feet to the ground below.    Shingle Rite Installers was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 311611495, citation number 1,  item number 2 and was affirmed as a final order on December 15, 2009 with respect to a workplace located at 2440 Holland Sylvania Rd., Toledo, Ohio.
