29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  (a) Shingle Rite Installers on or about February 23, 2017, at the address of 2110 Maplewood St. Toledo, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  Shingle Rite Installers on or about February 23, 2017, at the address of 2110 Maplewood St. Toledo, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing roofing operations from elevated surfaces.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)  Shingle Rite Installers on or about February 23, 2017, at the address of 2110 Maplewood St. Toledo, OH: The employer did not ensure employees were protected from falls while performing roofing activities atop a residential type structure. Employees operating in this condition were exposed up to a 20 ft. fall to the ground below.  Shingle Rite Installers was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 549258, citation number 2, item number 1 and was affirmed as a final order on December 03, 2012, with respect to a workplace located at 721 Colt Rd. Findlay, OH.
