29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) At the back room department -The employees working in the vicinity of the back room department were exposed to continuous noise at 270% of the permissible daily exposure of the 85 dBA (8 hour time weighted average) or an equivalent sound level of approximately 97.2 dBA during the 433 minute sampling period on August 8, 2012 without the implementation of an effective hearing conservation program which would have included baseline audiograms, noise monitoring, and noise training according to the noise standard. Exposure calculation included a zero increment for the 47 minutes not sampled. The employees were exposed to the loss of hearing.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Throughout facility -The employer did not implement a written hazard communication program to employees working with chemicals such as, but not limited to, propane, hydraulic oil, Cycoloy - Synthetic thermoplastic polymer, resin, and lubricant oil, exposing employees to eye, skin and respiratory tract irritations.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:    a) Throughout facility - The employer did not provide the information contained in Appendix D of respiratory protection program to employees that were permitted to use the 3M-8210 Plus - N95 respirators voluntarily at the working area, exposing employees to the respiratory tract irritations and diseases.
