29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) Jobsite - 1601 Wharton Street - Employees working on the tubular welded frame scaffold were exposed to fall hazards of 13 feet to 19.5 feet without the use of a guardrail system or personal fall arrest system.  Employees were working on the 2nd and 3rd levels of the scaffold on or about 8/3/12.      Abate certification and documentation required within 10 days after the abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement , and state the employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(b)(1):     Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:    a) Jobsite - 1601 Wharton Street- The working levels of the tubular welded frame scaffold were not fully planked between the front and rear uprights.  Employees were working on the 2nd & 3rd levels of the scaffold.  Observed on about 8/3/12.     Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    Jobsite -1601 Wharton Street -A ladder or other safe means of access was not provided to employees working on the tubular welded frame scaffold.  Employees were using the side frames and cross bracing to access the working levels. Obsreved on or about 8/3/12.     Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.

29 CFR 1926.454(a):     The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a) Jobsite - 1601 Wharton Street - The employer did not provide each employee performing bricklaying operations with training to recognize the hazards and to understand the procedures to control the hazards associated with scaffolds, on or about 8/3/12.      Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.
