29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a)  Navy Yard Visiting Flag Officers Quarters Renovation Project:  An asbestos removal worker performing Class I asbestos abatement work and exposed in removing asbestos containing thermal system insulation was required by his employer to personally pay for his own personal protective equipment, on or about March 16, 2012.    b)  Navy Yard Visiting Flag Officers Quarters Renovation Project:  An asbestos removal worker performing Class I asbestos abatement work and exposed in removing asbestos containing thermal system insulation was required by his employer to personally pay for his own personal protective equipment, on or about January 6, 2012.    c)  Navy Yard Visiting Flag Officers Quarters Renovation Project:  An asbestos removal worker performing Class I asbestos abatement work and exposed in removing asbestos containing thermal system insulation was required by his employer to personally pay for his own personal protective equipment, on or about January 6, 2012.    d)  Navy Yard Visiting Flag Officers Quarters Renovation Project:  An asbestos removal worker performing Class I asbestos abatement work and exposed in removing asbestos containing thermal system insulation was required by his employer to personally pay for his own personal protective equipment, on or about January 6, 2012.

29 CFR 1926.1101(k)(9)(i): The employer did not institute, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations:      a)  Navy Yard Visiting Flag Officers Quarters Renovation Project:  An asbestos removal worker performing Class I asbestos abatement work and exposed in removing asbestos containing thermal system insulation had paid for his own asbestos training, on or about January 6, 2012.       b)  Navy Yard Visiting Flag Officers Quarters Renovation Project:  An asbestos removal worker performing Class I asbestos abatement work and exposed in removing asbestos containing thermal system insulation had paid for his own asbestos training, on or about October 15, 2011.
