29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. a) Hudson Meridian Construction Group, 247 East 28 Street, New York NY On or about 08/07/12, Laborers perform cleanup activities adjacent to asbestos containing building materials are provided with half face negative pressure respirators equipped with HEPA filter. The employer did not provide a medical evaluation to ensure that employees are healthy enough to wear a respirator. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

Workers have not been fit tested on such respirators. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
