29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a)  LaCourse Painting Services on or about August 16, 2012, at the address of 308 New Towne Square Dr. Toledo, OH: The employer failed to ensure an employee performing painting work atop a commercial structure was protected from a fall. The employee working in this condition was exposed to an approximant 12 ft fall to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a)  LaCourse Painting Services on or about August 16, 2012, at the address of 308 New Towne Square Dr. Toledo, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems, guardrails or alternative acceptable measures while performing painting operations from an elevated surface.
