29 CFR 1910.23(d)(1):     Every flight of stairs having four or more risers shall be equipped with standard stair railings or standard handrails as specified in paragraphs (d)(1)(i) through (v) of this section, the width of the stair to be measured clear of all obstructions except handrails: On stairways less than 44 inches wide having both sides open, one stair railing on each side.    a) At the front of the facility, on or about and at times prior to August 1, 2012, the employer did not provide for a mid-rail on a flight of stairs, constructed with five risers, used by employees to access the break area, exposing employees to the hazards associated with sprains, lacerations, and bruises.    b) At the front of the facility, on or about and at times prior to August 1, 2012, the employer did not provide for a handrail for a flight of stairs, constructed with five risers, used by employees to access the break area, exposing employees to the hazards associated with sprains, lacerations, and bruises.    ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.110(h)(6)(ii)(b):     Containers shall be protected by crash rails or guards to prevent physical damage unless they are so protected by virtue of their location. Vehicles shall not be serviced within 10 feet of containers.    a) At the front of the building, on or about and at times prior to August 1, 2012, the employer did not ensure that a five hundred gallon tank of diesel fuel was guarded from the potential of physical damage by powered industrial vehicles that worked within ten feet of the tank, exposing employees to the hazards associated with death, burns, and smoke inhalation. 29 CFR 1910.134(f)(2):     The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.    a) In the production area, on or about and at times prior to August 8, 2012, the employer did not ensure that employees who wore half face respirators were subjected to an annual fit test, exposing employees to respiratory hazards.
