OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to fall and caught in between hazards as a result of working from an elevated front-end loader bucket.     a) West end of parking lot. An employee, trimming tree limbs, was exposed to being caught between hazards as well as a fall hazard of approximately 10 to 12 feet while working from an elevated bucket of a front-end loader.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:    a) West end of parking lot. An employee working from the elevated front-end loader bucket was exposed to injuries associated with being struck in the head by the limbs of the tree being pruned.
