OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by an excavator: On or about August 23, 2012, I-40 Bridge Deconstruction, Pier 91S, The employer did not ensure an employee was outside of the swing radius of a Caterpillar 325C hydraulic excavator, exposing an employee to the hazard of being struck by the back end of the excavator and being crushed between the back end of the excavator and a flatbed trailer in that: a. Manufacturers safety messages for machine swing were not present or legible

29 CFR 1926.600(a)(5): Equipment cab glass introduced visible distortion that affected the safe operation of the machine: On or about August 24, 2012, I-40 Bridge Deconstruction, Pier 91S, A track mounted excavator used to lift bridge beams had cracks at the upper left side of the front windshield which exposes operator employees to struck-by hazards.
