29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions prior to the start of work and as needed throughout the shift or after every rainstorm or other hazard increasing occurrence:    a) Jobiste, 9 Dominic Lane, Cheswick, PA: On or about August 24, 2012, during water line installation activities, the employer did not ensure that an appropraite trench inspection, conducted by a competent person, was done prior to the start of work. Deficiencies noted during the inspection included, but were not limited to, not conducting a proper soil analysis and trench cave-in protection analysis before an employee was allowed to enter the trench, at a depth measured to be approximately 5 1/2 feet in depth, to perform work.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Jobiste, 9 Dominic Lane, Cheswick, PA: On or about August 24, 2012, during water line installation activities, the employer did not ensure that dirt removed from the excvatation dig was kept at least 2 feet back from the edge of the excavation. This dirt was removed from the dig and placed along the road side of the trench, within 2 feet from the edge of the trench.
