29 CFR 1926.501(b)(11):     Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) Avenue E and Horsham Road, Worksite - On or about August 15, 2012, employees were installing roofing materials on an 8 in 12 pitch roof, no less than 11.5 feet above grade, without any means of fall protection.

29 CFR 1926.602(d):     The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):    a) Avenue E and Horsham Road, Worksite - on or about August 15, 2012, employees are operating a JCB 530BCL Variable Reach Rough Terrain Forklift without receiving powered industrial truck training and certification which has prevented them from being able to identify deficiencies with the forklift including, but not limited to, the requirement to use outriggers while lifting personnel and the lack of external electrical components such as headlights.
