29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employees' ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:      a)  On or about August 29, 2012, at the address of 1449 Middle Road, Avon, OH: the employer did not assure that employees received a medical evaluation prior to requiring the use of a respirator.  An employee was utilizing a two strap filtering face piece to protect themselves from being potentially exposed to silica while using a gas powered circular saw to cut masonry block.  A respirator can place a burden on an employees cardiovascular and respiratory systems.

29 CFR 1910.134(c)(1):     A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a)  On or about August 29, 2012, at the address of 1449 Middle Road, Avon, OH: the employer did not develop and implement a written respiratory program to protect employees from worksite respiratory hazards.  Employees were potentially exposed to silica while using a gas powered circular saw to cut masonry block creating dust.
