29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    On Chalan Guma Yuus on or about September 10, 2012, the seat belt was not worn while operating a 420 E Caterpillar backhoe to load broken up concrete into dump trucks.

29 CRF 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference:     On Chalan GumaYuus near the intersection with Mansinita Court in the village of Agana Heights; on or about September 10, 2012, the Manual on Uniform Traffic Control Devices Typical Application (TA-18) was not followed when there was a lane closure on a minor street:      Going northbound on Chalan GumaYuus the traffic control failed to have:  -About 140 to 200 feet from the work zone a Worker symbol sign  -About 40 to 100 feet from the work zone traffic cones that taper traffic to the left    Going southbound on Chalan GumaYuus the traffic control failed to have:  -About 100 feet from the work zone a Worker symbol sign     Trucks, a backhoe and employees were located on the road to load broken up concrete into dump trucks and install underground PVC pipe for a street light.
