29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents: a. On or about September 11, 2012, an employee using a Hitachi NR83A2 pneumatic air nail gun did not have on safety glasses, exposing himself to being hit by nails or flying debris.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about September 11, 2012, on the top plate, three employees performing framing operations were not protected from a 15.5 feet fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any fall protection.
