29 CFR 1910.1200(e)(1):     Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)    On or about September 20, 2012, at the worksite located at 43 Tournay Circle in Little Rock, Arkansas, a Hazard Communication Program had not been developed for the benefit of employee using and/or exposed to hazardous chemicals/ingredients such as but not limited to crystalline silica which was contained in the porcelain tile; silica, crystalline, quartz and Portland Cement contained in the PolyBlend Sanded Grout; silica quartz, silicate Portland cement, calcium sulfate and carbonate contained in the Porcelain Tile Fortified Thin-Set Mortar; and, silica, crystalline, quartz, Portland cement, alumina and calcium formate contained in the VersaBond Thin-Set Fortified Mortar, when cutting and applying porcelain tile.

29 CFR 1910.1200(g)(1):     Chemical manufacturers and importers did not obtain or develop a material safety data sheet for each hazardous chemical they produced or imported: (Construction Reference: 1926.59)    On or about September 20, 2012, at the worksite located at 43 Tournay Circle in Little Rock, Arkansas, Material Safety  Data Sheets were not maintained for hazardous chemicals/ingredients such as but not limited to Porcelain Tile, PolyBlend Sanded Grout, and Porcelain and VersaBond Fortified Thin-Set Mortar being used by employees to apply porcelain tile.

29 CFR 1926.102(a)(1):     Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    On or about September 20, 2012, at the worksite located at 43 Tournay Circle in Little Rock, Arkansas, employee using  a MK101 tile saw, s/n 150464, to cut porcelain tile to size did not wear eye protection.  Employee was exposed to the hazards of contact with dust particles and flying porcelain chips.

29 CFR 1926.300(b)(1):     Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:    On or about September 20, 2012, at the worksite located at 43 Tournay Circle in Little Rock, Arkansas, a guard was not   furnished over the approximately 4 ? inch diameter wheel on the DeWalt portable grinder.  This condition exposed employees to the hazard of contact with the rotating wheel.

29 CFR 1926.405(g)(2)(iii):     Splices. Flexible cords shall be used only in continuous lengths without splice or tap. Hard service flexible cords No. 12 or larger may be repaired if spliced so that the splice retains the insulation, outer sheath properties, and usage characteristics of the cord being spliced:    On or about September 20, 2012, at the worksite located at 43 Tournay Circle in Little Rock, Arkansas, the double   insulated flexible cord powering the DeWalt grinder was spliced to a zip/lamp cord.  This condition exposed employees   to an electrical shock hazard.

29 CFR 1926.405(g)(2)(v):     Cords passing through holes. Flexible cords and cables shall be protected by bushings or fittings where passing through holes in covers, outlet boxes, or similar enclosures:    On or about September 20, 2012, at the worksite located at 43 Tournay Circle in Little Rock, Arkansas, the power cord  to the DeWalt grinder ran from the protector cover where it was split in lieu of from the base of the handle.  This condition subjected the cord to damage such as but not limited to cuts, and employees to an electrical shock hazard.
