29 CFR 1910.272(d):  Emergency action plan. The employer shall develop and implement an emergency action plan meeting the requirements contained in 29 CFR 1910.38.    Oconee Grain Company did not develop and implement an emergency action plan meeting the requirements specified in 1910.38.  These requirements would include the following:    a.	Procedures for reporting a fire or other emergency,  b.	Procedures for emergency evacuation, including type of evacuation and exit route assignments,  c.	Procedures to be followed by employees who remain to operate critical plant operations before they evacuate,  d.	Procedures to account for all employees after evacuation,  e.	Procedures to be followed by employees performing rescue or medical duties, and   f.	The name or job title of every employee who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan.

29 CFR 1910.272(g)(1)(i):  The employer shall issue a permit for entering bins, silos, or tanks unless the employer or the employer's representative (who would otherwise authorize the permit) is present during the entire operation. The permit shall certify that the precautions contained in this paragraph (1910.272(g)) have been implemented prior to employees entering bins, silos or tanks. The permit shall be kept on file until completion of the entry operations.    Oconee Grain Company had employees performing work in permit required confined spaces (grain bins), and the employer did not issue a confined space permit prior to permitting employees to enter the permit required confined space.  This permit would ensure that the requirements of 1910.217(g) were being met and would include the following:    a.	All equipment de-energized and locked out,  b.	Atmospheric testing to ensure safe,  c.	Proper safety equipment provided to employees for potential hazards,  d.	Equipment provided for rescue operations,  e.	An observer present to observe operations and trained in rescue procedures, and  f.	No employee enters confined spaces in situations where a buildup of grain products could fall on them.

This program would establish the frequency and method(s) determined to reduce accumulations of fugitive grain dust in the following areas:    a.	Ledges,   b.	Floors,  c.	Equipment, and  d.	Other exposed surfaces.

The employer did develop and implement preventive maintenance procedures consisting of the following:    a.	Regularly scheduled inspections of at least the mechanical and safety control equipment associated with dryers, grain stream processing equipment, dust collection equipment including filter collectors, and bucket elevators, and  b.	Lubrication and other appropriate maintenance, in accordance with manufactures recommendations, or as determined necessary by prior operating records.

Practical training (demonstrations performed by the trainer and practical exercises performed by the trainee),  c.	Evaluation of the operators performance in the workplace.

The following items needed repaired prior to permitting employees to utilize it in the facility:    a.	Horn not functioning,  b.	Lights not functioning,  c.	Back-up light not functioning.

29 CFR 1910.178(q)(7):  Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    Oconee Grain Company had employees operate a powered industrial truck, and the employer did not conduct a daily powered industrial truck inspection.
