29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a)  Doyle Construction Inc. at 324 Upper Forest Rd, Idaho Springs, CO 80452:  On September 5, 2012, the exposing employer did not ensure that an employee locating and repairing a broken water line inside an excavation, that measured approximately 8.5 feet in depth, was protected from cave-in. An employee worked at the bottom of the excavation without using a protective system. Hazards in the excavation included vertical side walls, approximately one-foot of water at the bottom of the excavation, undercut portions in the vertical side walls, and evidence of soil sloughing. The opening of the excavation measured approximately 12 feet by 14 feet. This condition exposed the employee to a crushing hazard by excavation wall cave-in.

29 CFR 1926.1053(b)(15):  Ladders were not inspected by a competent person for visible defects:    (a)  Doyle Construction Inc. at 324 Upper Forest Rd, Idaho Springs, CO 80452:  On September 5, 2012, the exposing employer did not ensure that an aluminum extension ladder was inspected before use, in that the extension ladder was not used at designed by the manufacturer. One section of the extension ladder was removed. The section that was used to access the excavation on site was approximately 6.7 feet in length. This condition exposed the employee to a fall of approximately 8.5 feet.
