29 CFR 1910.132(a):   Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  a) Maintenance facility, trailer shop and parking lot - On or about September 25, 2012, employees who work on top of trailers to conduct repairs such as sealing leaks and repairing panels, at heights exceeding 10 feet above the ground, are not provided fall protection such as guardrail systems or personal fall arrest system, exposing them to serious injury in the event of a fall.

29 CFR 1910.147(c)(1):   The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Maintenance facility, tractor and forklift shop - On or about September 25, 2012, the employer had not implemented or trained employees in energy control procedures to utilize while conducting work on equipment including forklifts and tractors. Without an energy control program or training employees were exposed to various struck by and caught between hazards.
