29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: (a) At the cold storage facility: On October 3, 2012 and at times prior to; the employer failed to prevent the integration of shop-made man basket that attached to the the forks of the industrial truck without the approval of the manufacturer, exposing employees to falls from an improperly secured man basket.

29 CFR 1910.23(e)(2): Stair rails did not consist of a top rail, intermediate rail and/or posts, with the vertical height not more than 34 inches (86.36 cm) nor less than 30 inches (76.2 cm) from upper surface of top rail to surface of tread in line with face of riser at forward edge of tread: a) The Stair entrance to the office: On October 3, 2012 and at times prior to; the employer failed to prevent falls on stairways in accordance with regulations in that the guardrail did not have a mid-rail.
