29 CFR 1910.147(c)(6)(i):     The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.    The employer failed to protect employees from potential electrical hazards associated with performing maintenance on equipment while using written specific procedures that have not been reviewed within the past year.  This was most recently evident during the inspection of the facility located at 9101 Military Rd, Omaha, NE 68134, where the employer has employees performing maintenance tasks on shop equipment while using written specific procedures that have not been reviewed in over a year. 29 CFR 1910.212(a)(1):     Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    The employer failed to protect employees from potential point of operation hazards associated with operating drill press where point of operation hazards are prevalent without providing any form of guarding.  This was most recently evident during the inspection of the facility located at 9101 Military Rd, Omaha, NE 68134, where the employer has employees using a Ridgid Model #15500, serial # 02312E0213 drill press in the fabrication of parts and materials necessary in the manufacturing of solid counter tops without having protected the employee from point of operation guarding such as a chuck guard around the drill chuck during use.

29 CFR 1910.215(a)(4):     Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch:  (a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS) (DESCRIBE HAZARD(S) WHERE NECESSARY)    The employer failed to protect employees from potential struck by hazards associated with sharpening tools on a bench grinder where the tool rest is not adjusted properly.  This was most recently evident during the inspection of the facility located at 9101 Military Rd, Omaha, NE 68134, where the employer has employees using a General Machine Industrial model 36127 bench grinder to sharpen tools and the tool rest is set at 1/4th of an inch thus creating the potential for the tool to get caught between the rest and the fast spinning abrasive wheel.

29 CFR 1910.215(b)(9):     Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.)    The employer failed to protect employees from potential struck by hazards associated with sharpening tools on a bench grinder is missing a tongue guard.  This was most recently evident during the inspection of the facility located at 9101 Military Rd, Omaha, NE 68134, where the employer has employees using a General Machine Industrial model 36127 bench grinder to sharpen tools and the grinder is missing a tongue guard, thus exposing the employee to struck by hazards in the event the abrasive wheel was to shatter in use.

29 CFR 1910.134 App D:     Appendix D to Sec. 1910.134 (Mandatory) Information for Employees Using Respirators When Not Required Under the Standard  Respirators are an effective method of protection against designated hazards when properly selected and worn. Respirator use is encouraged, even when exposures are below the exposure limit, to provide an additional level of comfort and protection for workers. However, if a respirator is used improperly or not kept clean, the respirator itself can become a hazard to the worker. Sometimes, workers may wear respirators to avoid exposures to hazards, even if the amount of hazardous substance does not exceed the limits set by OSHA standards. If your employer provides respirators for your voluntary use, or if you provide your own respirator, you need to take certain precautions to be sure that the respirator itself does not present a hazard.   You should do the following:   1. Read and heed all instructions provided by the manufacturer on use, maintenance, cleaning and care, and warnings regarding the respirators limitations.   2. Choose respirators certified for use to protect against the contaminant of concern. NIOSH, the National Institute for Occupational Safety and Health of the U.S. Department of Health and Human Services, certifies respirators. A label or statement of certification should appear on the respirator or respirator packaging. It will tell you what the respirator is designed for and how much it will protect you.   3. Do not wear your respirator into atmospheres containing contaminants for which your respirator is not designed to protect against. For example, a respirator designed to filter dust particles will not protect you against gases, vapors, or very small solid particles of fumes or smoke.   4. Keep track of your respirator so that you do not mistakenly use someone else's respirator.   [63 FR 1152, Jan. 8, 1998; 63 FR 20098, April 23, 1998]    The employer failed to provide employees with information on the voluntary use of respirators and the hazards associated with using them.   This was most recently evident during the inspection of the facility located at 9101 Military Rd, Omaha, NE 68134, where the employer is providing N95 and half mask respirators to employees under a voluntary use status without having informed those employees of the potential hazards associated with using respirators as outlined in Appendix D of this subpart.
