29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    (a) Cooper Plaza, Route 73 S. Voorhees, NJ, North Side of Structure: Employees were accessing the top platform from the side bracket, (34 inches) by climbing the cross braces and end frames, observed on or about 10/10/12.    (b) Cooper Plaza, Route 73 S. Voorhees, NJ, North Side of Structure: A ladder was not provided for employees to use to access the third level of the scaffold , observed on or about 10/10/12.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart.    (a) Cooper Plaza, Route 73 S. Voorhees, NJ, North Side of Structure: Cross bracing used on the scaffold was at an acceptable height to be used as a midrail; however there was no top rail , observed on or about 10/10/12.
