29 CFR 1926.28(a):  The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.    (a)  On or about October 22, 2012, and at times prior thereto, the employer did not require the use of seatbelts when operating a Toyota fork truck. The Toyota fork truck was used to lift and support a job made elevating personnel platform.      Seatbelts are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a accident, and that the failure to wear the seat belts that are provided in the fork truck increases the risk of injury to the operator in the event of an accident.

29 CFR 1926.451(c)(2)(iv):     Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    (a)  At the project site on or about October 22, 2012, and at times prior thereto, a Toyota fork truck was used to lift and support a job made elevating personnel platform.  The job made elevating personnel platform was not specifically designed by the manufacturer for such use.
