29 CFR 1926.304(d):  All portable, power-driven circular saws were not equipped with guards below the base plate or shoe.  The lower guard shall cover the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work. When the tool is withdrawn from the work, the lower guard shall automatically and instantly return to the covering position:    This violation was most recently observed on October 24, 2012, at the worksite located at 10102 Lake June Road, Dallas, Texas 75217; where employees were exposed to struck-by hazards while using a Makita 7 1/4-inch circular saw with the lower guard in the opened position.
