OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by and/or crushed-by hazards: On or about November 6, 2012, two employees at Hollingsworth Logistics were operating forklifts without utilizing restraint devices. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that all forklift drivers utilize the restraint devices provided on the forklifts as stated in ASME B56.1- 2000.
