29 CFR 1910.38(b):   An emergency action plan was not in writing, kept in the workplace, and available to employees for review:  On or about November 14, 2012, the employer did not provide the workplace with a written evacuation plan for employees working in the facility, exposing employees to hazards during an emergency situation.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employees are properly notified in case of an emergency of means of safety and egress.

29 CFR 1910.1200(e)(1)(i):   The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet.  On or about November 14, 2012, the employer could not provide a list of the hazardous chemical and/or products used in the Bayside Spa and Fitness, exposing the absorption, inhalation, and injection hazards.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a list is provided for the program and employee use.

On or about November 14, 2012, the employer did not provide the employees working at Bayside Spa and Fitness with training on the hazards of the chemicals/products used, exposing the employees to absorption hazards.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employees are properly trained on chemicals and/or products used.

On or about November 14, 2012, an OSHA Form 301 or equivalent for the following work-related injuries or illnesses was not filled out or incorrectly filled for the calendar years 2009 and 2010. For each 301 case, identify the injury or illness, work-relationship, the appropriate recording criteria and specify whether not filled out or what was missing.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the OSHA Form 301 or equivalent is used to record occupational injuries and illnesses at the workplace.
