29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a) Construction Site: On or about November 21, 2012 and at times prior thereto, employees were exposed to fall hazards of approximately 11 feet to the level below while accessing and exiting from the fourth floor of the building.    (b) Construction Site: On or about November 21, 2012 and at times prior thereto, as the controlling employer, TKO Construction, did not ensure its sub-contractor, Michael Noeller Contracting, LLC., protected their employees from fall hazards of approximately 11 feet to the level below while working on the fourth floor of the building.    (c) Construction Site: On or about November 21, 2012 and at times prior thereto, as the controlling employer, TKO Construction, did not ensure its sub-contractor, Gerald Nash Electric, protected their employees from fall hazards of approximately 11 feet to the level below while working on the fourth floor of the building.

29 CFR 1926.1052(c)(1)(i):     Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:    (a) Construction Site: On or about November 21, 2012 and at times prior thereto, employees were exposed to falls while using unguarded stairways to access and exit the building.    (b) Construction Site: On or about November 21, 2012 and at times prior thereto, as the controlling employer, TKO Construction, did not ensure its sub-contractor, Michael Noeller Contracting, LLC., protected their employees from fall hazards while using unguarded stairways to complete framing and truss setting activities.    (c) Construction Site: On or about November 21, 2012 and at times prior thereto, as the controlling employer, TKO Construction, did not ensure its sub-contractor, Gerald Nash Electric, protected their employees from fall hazards while using unguarded stairways to install electrical equipment.
