29 CFR 1926.102(a)(1):     Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    On or about 28 November 2012, and at times prior thereto, an employee was operating a circular hand saw to cut pieces of decking without the use of eye protection, exposing the employee to the hazard of being struck by flying objects.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employee are provided and utilize eye protection when the potential for flying objects exists.

On or about 28 November 2012, and at times prior thereto, an employee was conducting decking work on a 8 to 12 pitch roof without fall protection, exposing the employee to a fall hazard of approximately 10 feet to the ground below.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees are provided and utilize fall protection when work is above 6 feet from the ground or a lower level.
