29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) The Village at Mill Creek Subdivision, Lot 24 - On or about November 30, 2012, employees installing floor joists were exposed to fall hazards up to approximately 11 feet, 8 inches onto earthen and concrete ground because the workers were not fall protected by conventional fall protection.    b) The Village at Mill Creek Subdivision, Lot 24 - On or about December 4, 2012, employees erecting exterior walls were exposed to fall hazards up to approximately 11 feet, 8 inches onto earthen ground because the workers were not fall protected by conventional fall protection. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a rigid support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the ladder:   a) The Village at Mill Creek Subdivision, Lot 24 - On or about November 30, 2012, employees used an aluminum extension ladder to gain access to the second story of an apartment building without the side rails of the ladder being extended at least 3 feet above the upper landing surface of the upper landing surface nor was the ladder secured at its top to a rigid support, exposing employees to fall hazards of up to approximately 11 feet, 8 inches onto earthen ground.      b) The Village at Mill Creek Subdivision, Lot 24 - On or about December 4, 2012, employees used an aluminum extension ladder to gain access to the second story of an apartment building without the side rails of the ladder being extended at least 3 feet above the upper landing surface of the upper landing surface nor was the ladder secured at its top to a rigid support, exposing employees to fall hazards of up to approximately 11 feet, 8 inches onto earthen ground.
