29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.      Located at 344 St. Marks Avenue, Brooklyn, NY    On or about December 18, 2012    a)  An Employee operating a Bobcat S150 and was not trained and evaluated as required.  Employee had been operating the Bobcat S150 on the worksite for approximatley 1 week.      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.850(h): When debris was dropped through holes in the floor without the use of chutes, signs warning of the hazard of falling materials were not posted at each level:    Located at 344 St. Marks Avenue, Brooklyn, NY    On or about December 18, 2012    a)  Materials were being dropped  through holes in the floor without the use of chutes from the roof to the 2nd floor and from the 2nd floor to the 1st floor and no signs warning of the hazards of falling materials were posted .      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.856(a):  Floors or working surfaces were not of sufficient strength to support the imposed load of mechanical equipment:    Located at 344 St. Marks Avenue, Brooklyn, NY    On or about December 18, 2012    a) An Employee operating a Bobcat S150 fell approximately 14 feet from the 2nd floor to the 1st floor when the floor collapsed during a building demolition.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.856(b):  During demolition operation(s), floor openings did not have curbs or stop-logs to prevent the mechanical equipment from running over the edge:  Located at 344 St. Marks Avenue, Brooklyn, NY    On or about December 18, 2012    a)  Floor opening on the 2nd floor used as chute to drop debris/materials during demolition was not provided with curb, stop logs or bumper at edge of opening.  A Bobcat S150 was being used on the 2nd floor to haul the debris/materials and drop through floor opening.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
