Employee had been operating the Bobcat S150 on the worksite for approximatley 1 week. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.856(b): During demolition operation(s), floor openings did not have curbs or stop-logs to prevent the mechanical equipment from running over the edge: Located at 344 St. Marks Avenue, Brooklyn, NY On or about December 18, 2012 a) Floor opening on the 2nd floor used as chute to drop debris/materials during demolition was not provided with curb, stop logs or bumper at edge of opening. A Bobcat S150 was being used on the 2nd floor to haul the debris/materials and drop through floor opening. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
