On or about December 18, 2012, at the above addressed jobsite, safety inspections were not made by persons capable of identifying and correcting those hazards which would assure compliance with the company's safety program.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: a. On or about December 18, 2012, at the above addressed jobsite, employees shingling the 8/12 pitched roof were exposed to falls of approximately 20 feet (2 stories) due to the lack of fall protection. MARTIN MRVAN DBA M M ROOFING WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315156448, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 14, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 1808 HERMITAGE DRIVE IN NEW LENOX, IL.
