29 CFR 1926.100(a): Employee working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a) Worksite, 610 E. Broadway, Long Beach, NY: Employees were not wearing a protective helmet and were exposed to being struck by over head materials such as, but not limited to hand tools while working directly below the scaffold; on or about 1/11/13. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: a) Worksite, 610 E. Broadway, Long Beach NY: Employee doing steel work on a column of a construction house was exposed to fall hazards while standing on a 7ft A-frame ladder in a closed position; on or about 1/11/13. NOTE: Because abatement of this violation is already documented in the case file, the employer need not to submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
