29 CFR 1926.451(f)(4): Part(s) of a scaffold that were damaged or weakened, such that the scaffold's strength was less than that required by paragraph (a) of this section, were not immediately repaired, replaced, or braced to meet those provisions, nor removed from service until repaired: a) In Building A-1, on or about December 19, 2012 - The employer allowed employees to use a Metaltech 6' multipurpose maxi square Baker-style rolling scaffold on which two of the four 5" caster wheels were damaged and unable to be locked in place, exposing employees to potential fall hazards.

29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner: a) At the work site, 4410 Westheimer Road, Houston, Texas 77027, on or about December 19, 2012 - Employees were exposed to fall hazards of 6' while working from a Metaltech Multipurpose maxi-square Baker-style scaffold (MN I-C1SC SN UK) on which the 5" casters were not locked into position.
