OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while riding on an excavator bucket. (a) East Side of Worksite - On or about January 29, 2013 an employee was exposed to fall and impalement hazards while being lifted on the bucket of a Bobcat compact excavator. The employee was not protected by his employer following the manufacturer's Operating and Safety Instructions which prohibits riding on the bucket.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: (a) Multiple Trenches throughout Worksite - On or about January 29, 2013 employees were exposed to impalement hazards while working near trenches with exposed reinforcing steel. Employees were not protected by covering or guarding over the reinforcing steel.
