29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or orther hazardous conditions:    a)  Excavation, East of Print Shop:  A competent person was not on site to make inspections as needed throughout the shift, on or about 2/5/2013.    Abatement note:  To be a "competent person" under this standard, a person must have had training in, and be knowledgeable about, soils analysis, the use of protective systems and the requirements of this standard.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper that one and a half horizontal to one verticle (34 degrees measured fron the horizontal):    a)  Excavation, East of The Print Shop:  Employee was working in an unprotected excavation which caved-in, on or about 2/5/2013.
